Privacy Notice

LAVIEN Inc. ("LAVIEN," "we," "us," or "our") operates lavien.com and collagen.lavien.com. This Privacy Notice explains what personal information we collect, how we use it, who we share it with, and the choices you have.

By using our sites or services, you agree to the practices described here.

1. Information we collect

Information you give us:

  • Name, email address, postal address, and phone number
  • Payment information (processed by our payment providers — see Section 6)
  • Order history, subscription preferences, and delivery instructions
  • Account credentials
  • Product reviews, survey responses, and correspondence with customer service
  • Marketing preferences, including SMS and email opt-in status

Information collected automatically:

  • IP address, browser type, operating system, and device identifiers
  • Pages viewed, time on site, referring URLs, and links clicked
  • Cookies and similar technologies (see Section 8)

Information from third parties:

  • Order and fulfillment data from our shipping and logistics providers
  • Fraud-prevention signals from payment processors
  • Aggregated advertising and analytics data

2. How we use your information

We use personal information to:

  • Process, fulfill, and deliver your orders
  • Manage subscriptions, including recurring billing and shipment scheduling
  • Provide customer service and respond to inquiries
  • Send transactional messages (order confirmations, shipping notices, subscription renewal reminders)
  • Send marketing communications where you have opted in
  • Improve our products, website, and customer experience
  • Detect and prevent fraud
  • Comply with legal obligations

3. SMS and RCS messaging program

Consent. By providing your mobile phone number and opting in, you consent to receive recurring automated marketing and transactional text messages from LAVIEN at the number provided. Consent is not a condition of any purchase.

Message frequency. Message frequency varies.

Rates. Message and data rates may apply.

Opting out. You may opt out at any time by replying STOP to any message. You will receive a single confirmation message and will not receive further marketing texts.

Help. Reply HELP for assistance, or contact us at hello@lavien.com.

Carriers. Carriers are not liable for delayed or undelivered messages.

Age. You must be at least 18 years old to opt in to our messaging program.

Mobile information sharing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Providers. We use Klaviyo, Inc. and its messaging partners to deliver SMS and RCS messages on our behalf. These providers act as service providers and process your information only as necessary to deliver messages we request.

4. Email marketing

With your permission, we send emails about products, offers, and updates. You can unsubscribe at any time using the link in any marketing email or by contacting hello@lavien.com. Transactional emails relating to your orders or subscriptions are not marketing messages and will continue regardless of marketing preferences.

5. Subscriptions and recurring billing

If you enroll in a subscription:

  • We store your subscription preferences, billing cadence, and payment method token to process recurring charges.
  • We send transactional notifications before charges and shipments.
  • You may cancel, pause, or modify your subscription from your account or by contacting hello@lavien.com.
  • Cancellation stops future charges. Your account and order history are retained as described in Section 10.

6. Payments and hosting

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell to you. Your data is stored through Shopify's data storage, databases, and applications, on secure servers behind a firewall.

If you use a direct payment gateway, your payment card data is encrypted under the Payment Card Industry Data Security Standard (PCI-DSS). Transaction data is retained only as long as necessary to complete your purchase, then deleted.

All direct payment gateways adhere to PCI-DSS standards managed by the PCI Security Standards Council.

7. Disclosure and third parties

We do not sell your personal information.

We share personal information with:

  • Service providers who perform functions on our behalf — payment processing, shipping and fulfillment, email and SMS delivery, customer service, analytics, and fraud prevention. These providers may use your information only to perform services for us.
  • Legal and safety — where required by law, legal process, or to protect our rights, or if you violate our Terms of Service.
  • Business transfers — if LAVIEN is acquired or merged, your information may transfer to the new owner so we can continue serving you.

Third-party providers may be located in jurisdictions different from yours. If you proceed with a transaction involving such a provider, your information may become subject to the laws of that jurisdiction.

Once you leave our site or are redirected to a third-party site, this Privacy Notice no longer governs. We are not responsible for the privacy practices of other sites.

8. Cookies, analytics, and advertising

We use cookies and similar technologies to operate the site, remember preferences, measure performance, and support advertising.

We use analytics and advertising services that may set cookies or collect device identifiers, including Google Analytics and Google Tag Manager. These providers may use this information to measure site usage and, where applicable, to serve advertising.

You can control cookies through your browser settings. Blocking some cookies may affect site functionality.

We honor Global Privacy Control (GPC) signals where required by law.

9. Your privacy rights

Depending on where you live, you may have the right to:

  • Know what personal information we collect, use, and disclose
  • Access a copy of your personal information
  • Correct inaccurate personal information
  • Delete your personal information
  • Opt out of the sale or sharing of personal information, and of targeted advertising
  • Not be discriminated against for exercising these rights

California residents have these rights under the California Consumer Privacy Act as amended by the CPRA. We do not sell personal information as defined by the CCPA.

Residents of other states with comprehensive privacy laws — including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and Montana — have similar rights.

To exercise any of these rights, contact hello@lavien.com. We will verify your identity before responding. You may designate an authorized agent to make a request on your behalf.

10. Data retention

We retain personal information for as long as needed to provide our services, comply with legal obligations, resolve disputes, and enforce agreements. Order records are typically retained for seven years for tax and accounting purposes. Marketing contact information is retained until you opt out or request deletion.

11. Consent and withdrawal

When you provide personal information to complete a transaction, verify a payment method, place an order, arrange delivery, or return a purchase, you consent to our collecting and using it for that purpose.

If we request personal information for a secondary purpose such as marketing, we will ask for your express consent or provide an opportunity to decline.

12. Security

We take reasonable precautions and follow industry best practices to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, or destruction.

Payment card information is encrypted using SSL/TLS and stored with AES-256 encryption. No method of transmission or electronic storage is completely secure, but we follow PCI-DSS requirements and generally accepted industry standards.

13. Children

Our services are not directed to children under 13, and we do not knowingly collect personal information from them. You must be at least 18 to opt in to our SMS program. If you believe a child has provided us personal information, contact hello@lavien.com and we will delete it.

14. Changes to this notice

We may modify this Privacy Notice at any time. Changes take effect upon posting. If we make material changes, we will note the update here so you are aware of what we collect, how we use it, and under what circumstances we disclose it.
