Terms of Service

These Terms of Service ("Terms") govern your use of lavien.com, collagen.lavien.com, and any related services operated by LAVIEN Inc. ("LAVIEN," "we," "us," or "our").

By accessing our sites or placing an order, you agree to these Terms. If you do not agree, do not use our services.

You must be at least 18 years old, or the age of majority in your state of residence, to place an order or opt in to our messaging program. By using this site you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at hello@lavien.com if you believe your account has been accessed without authorization.

Our products are cosmetics intended for external topical use only. They are not drugs and are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration.

Do not ingest our products. Discontinue use and consult a physician if irritation occurs. Patch test before first use if you have sensitive or reactive skin.

Product descriptions, ingredient listings, and imagery are provided for information. We make reasonable efforts to display products accurately, but colors and appearance may vary by screen.

Prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors and to refuse or cancel any order placed at an incorrect price, including after an order has been submitted.

All products are subject to availability. If an item you ordered is out of stock, we will notify you by email. If an out-of-stock item is not expected to return, we will cancel that item and will not charge you for it or for related tax and shipping. If your order includes other items, tax and shipping for those items still apply.

Accepted payment methods: American Express, Discover, Mastercard, and Visa. We also accept prepaid credit card gift cards.

Not accepted: cash on delivery, checks, and money orders.

Billing address. Your billing address must match the address on file with your card issuer. Mismatched addresses may delay processing.

When you are charged. For one-time orders, your card is charged when your order ships. If you pay with a debit or check card, funds may be deducted immediately. For prepaid cards, the full amount is charged when the order is placed. If your purchase exceeds the value of your prepaid card, you may pay the difference with another method.

Promotional codes. Each promotion has a code entered at checkout. Multiple codes may not be combined unless expressly stated. If you cancel an item purchased under a promotion, you may not be eligible to receive that promotion again.

By enrolling in a subscription, you authorize LAVIEN to charge your payment method on a recurring basis until you cancel.

Billing cycle. Subscriptions bill every four weeks unless otherwise stated at checkout. Your first charge occurs at enrollment; subsequent charges occur automatically at the start of each cycle.

Price. The subscription price is displayed at checkout. We will notify you in advance of any price change and you may cancel before it takes effect.

Cancellation. You may cancel at any time from your account or by contacting hello@lavien.com. Cancellation must be completed before the next billing date to avoid that charge. Cancellation stops future charges; it does not refund charges already processed or orders already shipped.

Changes. You may modify your delivery frequency, payment method, or shipping address from your account, subject to processing cutoffs.

Failed payments. If a payment fails, we may retry the charge and may suspend your subscription until payment succeeds.

Returns on subscription orders are governed by our Returns policy.

Our fulfillment process moves quickly, so the window to change or cancel is short. You may request cancellation within approximately one hour of placing your order by contacting hello@lavien.com. If we cannot cancel in time, you may return your purchase under our Returns policy.

Shipping terms are described in our Shipping policy. Returns and refunds are governed by our Returns policy. Both are incorporated into these Terms.

Consent. By providing your mobile number and opting in, you consent to receive recurring automated marketing and transactional text messages from LAVIEN at the number provided, including messages sent using an automatic telephone dialing system. Consent is not a condition of any purchase.

Program description. Messages may include order and shipping updates, subscription notifications, product announcements, and promotional offers.

Message frequency. Message frequency varies.

Rates. Message and data rates may apply.

Opting out. Reply STOP to any message to opt out. You will receive one confirmation message and no further marketing texts.

Help. Reply HELP for assistance, or contact hello@lavien.com.

Carriers. Carriers are not liable for delayed or undelivered messages.

Eligibility. You must be at least 18 years old to participate.

Supported carriers. Message delivery depends on your carrier and is not guaranteed.

Privacy. Mobile opt-in information is handled as described in our Privacy Notice. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

By providing your email address, you agree to receive transactional messages relating to your orders and subscriptions. Marketing emails are sent only with your consent and you may unsubscribe at any time using the link in any marketing email.

All content on our sites — text, imagery, product photography, logos, and design — is owned by LAVIEN or its licensors and protected by intellectual property law. You may not reproduce, distribute, or create derivative works without our written permission.

If you submit a review, photo, or other content, you grant LAVIEN a non-exclusive, royalty-free, worldwide license to use, reproduce, and display it in connection with our business.

You are responsible for the content you submit. Do not submit content that is false, misleading, unlawful, infringing, or that you were compensated to provide without disclosing that compensation.

We may remove content at our discretion. We do not edit reviews to change their substance and do not suppress reviews based on rating.

You may not use our sites to violate any law, infringe our rights or those of others, transmit malicious code, attempt unauthorized access, scrape or harvest data, or resell our products without authorization.

Our services and products are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Individual results vary. Statements about product performance describe the appearance of skin and are not claims of medical or therapeutic effect.

We do not warrant that our sites will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, LAVIEN and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our sites or products.

Our total liability for any claim relating to a product will not exceed the amount you paid for that product.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless LAVIEN from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party right.

Our sites may link to third-party websites. We are not responsible for their content, terms, or privacy practices.

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Virginia, and you consent to their jurisdiction.

We may update these Terms at any time. Changes take effect upon posting. Your continued use of our sites after changes are posted constitutes acceptance.
